Please read these Terms carefully before using CertDesk services.

Introduction

Welcome to CertDesk. These Terms & Conditions ("Terms") govern your use of our website, mobile applications and services (collectively, the "Services"). By accessing or using CertDesk, you agree to these Terms. If you do not agree, please do not use the Services.

1. Definitions

For the purposes of these Terms:

  • "Client" means any individual or entity using or receiving Services from CertDesk.
  • "Services" includes certification facilitation (ISO, GMP, QEAA, MSME), company formation, attestation, trademark assistance and related advisory services.
  • "We/Us/Our" refers to CertDesk and its affiliates.

2. Services Offered

CertDesk provides one or more of the following services (non-exhaustive):

  • ISO certifications (e.g., ISO 9001, 14001, 45001)
  • GMP certification for food, pharma and nutraceutical businesses
  • QEAA / Education accreditation
  • MSME registration & certification
  • Company formation (Private Limited, LLP, OPC, Section-8)
  • Document attestation, apostille and embassy filing assistance
  • Trademark filing and brand protection
  • Advisory, documentation, pre-audit checklists and compliance training

3. Eligibility

To use our Services you must:

  • Be at least 18 years old.
  • Have the legal capacity to enter into agreements for your organization (if applicable).
  • Agree to provide accurate, truthful and up-to-date information and documents when requested.

4. Service Process & Client Obligations

The typical workflow for most certification and compliance services is:

  1. Client submits an application and uploads required documents.
  2. Our team reviews documents and advises on gaps or corrective actions.
  3. Audit scheduling (on-site / remote) and execution by accredited auditors where applicable.
  4. Issuance of the certificate with QR-based digital verification (when applicable).

Clients must supply complete and accurate documents. Any delay in providing required information may delay the service timeline and could incur additional charges.

5. Pricing, Invoices & Payments

Our fees are set out in service proposals, invoices, or on pages where the service is described. Key points:

  • Quoted prices exclude taxes (GST), government or statutory fees and any third-party charges. Such charges are payable by the client in addition to our fees.
  • Our standard payment milestones (unless otherwise agreed in writing): 50% advance, 30% at mid-stage, 20% on completion.
  • We accept payment via the methods listed on our website or invoice. Bank transfer and online payments clear times may vary.
  • Invoices not paid within agreed terms may attract interest and the service may be suspended until payment is made.
  • If any additional work is required due to incomplete client submissions or changed requirements, extra charges may apply and will be communicated in writing.

6. Commission & Promoter Programs

If you are part of a promoter or referral program, commissions are paid as per the promoter agreement. Commission rates may vary by product and over time, and are subject to TDS and administrative deductions as per applicable laws. Promoter benefits, e.g., training or insurance, are governed by separate program terms.

7. Certificate Issuance, Validity & Renewal

Certificates issued by or through CertDesk are valid for the term specified on the certificate and are subject to the issuing body's terms (where applicable). Renewal is the client's responsibility; renewal timelines and costs vary by certificate type.

8. Investment & Loyalty Notes

CertDesk may, at its discretion, invest portions of its profits into financial instruments. Any loyalty, rewards, or savings mechanisms offered by the company are governed by separate program terms and are not guaranteed. Clients do not have ownership of company investments unless explicitly stated in a separate agreement.

9. Records, Data & Confidentiality

We will treat client information as confidential and only use it to deliver the Services, except where disclosure is required by law or by competent regulatory authorities. Clients consent to secure storage and processing of documents required for compliance and certification purposes.

10. Client Warranties & Representations

By engaging our Services, you represent and warrant that:

  • All information and documents provided are true, accurate and complete.
  • You have authorization to submit information on behalf of any organization you represent.
  • You will comply with any reasonable requests for additional information needed to complete the Services.

11. Intellectual Property Rights

All website content, templates, systems, designs and materials provided by CertDesk remain our intellectual property unless a separate written agreement states otherwise. Clients receive a limited licence to use deliverables strictly for their internal business needs only.

12. Limitation of Liability

To the maximum extent permitted by law, CertDesk and its officers, employees and agents shall not be liable for:

  • Indirect, incidental, special, consequential or punitive damages arising from use of the Services;
  • Delays, refusals or rejections by government authorities or third-party agencies;
  • Losses resulting from inaccurate or fraudulent documents supplied by clients.

Our total aggregate liability for any claim shall be limited to the fees paid by the client for the particular service giving rise to the claim.

13. Indemnity

You agree to indemnify, defend and hold CertDesk harmless from any claims, liabilities, damages, losses and expenses arising from your breach of these Terms, misuse of the Services, or submission of inaccurate or unlawful information.

14. Termination & Suspension

We may suspend or terminate Services and access if:

  • You breach these Terms and fail to remedy within a reasonable time;
  • Required payments are not made;
  • We are required to do so by any competent authority or law.

Termination will not relieve you of accrued payment obligations or liabilities incurred prior to termination.

15. Third-Party Links & Services

Our site may contain links to third-party resources. Links do not imply endorsement. We are not responsible for third-party content, privacy practices or terms; you use such links at your own risk.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute will be referred to the courts located in Pune, Maharashtra, which shall have exclusive jurisdiction.

18. Changes to Terms

We may update these Terms occasionally. We will post changes on this page with an updated effective date. Continued use of Services after changes indicates your acceptance of the revised Terms.
